TERMS AND CONDITIONS FOR PERFECTING YOUR JOURNEY CONTEST
  1. This Event is hosted and run by Tumi Asia, Limited (“Tumi”) in accordance with these Terms and Conditions.
  2. This Event will run from 18 April 2019 until 30 June 2019 inclusive (the “Term”).
  3. To enter into this Event, customers (“Eligible Customers”) shall, during the Term:
    1. purchase Tumi products from the Tumi online store at https://www.tumi-hk.com (“Tumi Online Store”) and
    2. submit in words, videos and/or photos a story of his/her travelling journey (“Story”) at the designated webpage together with his/her Personal Data (defined below), purchase order number and product name.
  4. By entering into the Event, Eligible Customers are bound by these Terms and Conditions.
  5. Judges appointed at the sole discretion of Tumi shall select six (6) Eligible Customers who submitted the most creative and interesting Story as Prize Winners. The Prizes are as follows:
    1. 3-night-4-day stay in a Double Sea View room at one of Myconian Collection’s 9 properties in Greece (quantity: 2).
    2. a 2-night-3-day stay in Iniala Penthouse at Iniala Beach House in Phuket, Thailand.
    3. a 2-night-3-day stay in Ocean View Pool Junior Suite at Trisara in Phuket, Thailand.
    4. a 2-night-3-day stay in a Garden Villa at The Farm at San Benito, Batangas, Philippines.
    5. a 2-night-3-day stay in Ocean View Pool Villa at Amatara Wellness Resort at Phuket, Thailand.
  6. Tumi reserves the right to substitute any of the Prizes without further notice and the Prize Winners may not object to any decision of Tumi which shall be final.
  7. Eligible Customers shall not submit Stories that contain abusive, offensive, obscene, threatening languages or political, religious, racist or discriminatory opinion. Tumi reserves the right to disqualify any Eligible Customers from participation in the Event without notice or giving reasons, and without compensation to the Eligible Customers.
  8. Your name, mobile phone number, email address and purchase information (“Personal Data”) collected by Tumi will be used for enabling your participation in this Event, communicating with you with regards to your questions about this Event, and to notify you in case you become one of the Prize Winners. Tumi’s collection and processing of your Personal Data shall be in accordance with the Tumi Privacy Policy at https://www.tumi-hk.com/privacy-policy/ . Personal Data collected by Tumi will not be sold, provided or transferred out of the Samsonite Group except that Personal Data may be provided to third-party suppliers or service providers used in connection with Event. Personal Data will not be provided to third parties for direct marketing or purposes unrelated to the Event without prior consent of the Eligible Customers concerned.
  9. Eligible Customers may enter into the Event once per every transaction number on their invoice. Any duplicated transaction number submitted shall be void.
  10. Personal Data submitted by Eligible Customers must be identical with those appearing on their identity cards.
  11. By submitting the Story, the Eligible Customer agrees that all title, rights, and interest, including intellectual property rights, in the text, videos and/or photos of the Story shall immediately vest in Tumi, Inc. The Eligible Customer shall, at the request and cost of Tumi, take such actions and execute any document as is reasonably necessary and as Tumi requires to vest properly all such rights in it or (where directed by it) in its nominee and secure all appropriate forms of protection for and defend and enforce such rights. The Eligible Customer warrants that he/she has all right, title and interest including all intellectual property rights constituting, embodied in or pertaining to the Story or any parts thereof, and all necessary permits and consent from any third party in order for the right, title and interest in the Story to vest in Tumi. The Eligible Customer agrees to defend, hold harmless and indemnify Tumi (including any other member of the Samsonite and Tumi group of companies, and the respective directors, officers and employees of Tumi and of such Samsonite/Tumi entities) against claims, liabilities and expenses, including legal fees and any direct or consequential expenses, which may arise from the negligent or wrongful actions or omissions of the Eligible Customer, or breach of its warranty in this Clause by the Eligible Customer in relation to the Story.
  12. The Eligible Customer agrees that his/her Story may be published on the Tumi website, any of the websites of Tumi’s affiliate companies, Tumi’s newsletters and social media accounts including but not limited to Facebook, YouTube, Instagram and Google.
  13. Prize Winners shall be contacted and notified via email and SMS at the second week of July 2019. It is the responsibility of each Eligible Customer to provide a valid and functioning email and mobile phone number with SMS function. Prize Winners who cannot be contacted or located will be deemed to have forfeited the Prizes and no replacement of the Prizes will be made. Tumi reserves the right to offer the Prize to another Eligible Customer or Prize Winner in its sole and absolute discretion.
  14. The Prizes will be distributed in the form of vouchers. The Prize Winners must produce his/her identification document and original receipt of purchase for verification of identity before collection of vouchers. Vouchers cannot be replaced in case of loss. The vouchers cannot be exchanged for cash and cannot be combined with any hotel promotions or other forms of discount.
  15. The Prizes are not provided or run by Tumi. Tumi is not responsible in any event for any third party’s failure in delivering or the availability of any services or part thereof in relation to the Prizes. To the maximum extent permitted by law, Tumi disclaims all liability with regards to the merchantability and fitness for purpose of any of the Prizes and services relating thereto, and shall under no circumstances be liable to the Eligible Customer or the Prize Winners for any damages that they may suffer in connection with any services in relation to the Prizes. Prize Winners shall familiarize themselves with any terms and conditions published by the relevant third parties providing the services in relation to the Prizes and direct all enquiries to such third parties.
  16. In the interest of fairness, employees of Tumi, their immediate family members, and any other parties directly involved in organizing, promoting, or conducting the Event are not eligible to participate in the Event.
  17. In case of dispute, Tumi’s decision is final. In no event shall the Eligible Customer or Prize Winner dispute or object to the decision of Tumi or the judges whatsoever.
  18. Prize Winners shall collect the Prizes at the designated collection site specified in the notification SMS, together with the original copy of their identity card or passport (the Personal Data appearing on which shall be identical with those submitted by the Prize Winners) within one (1) month of announcement of the Prize Winners. Prize Winners shall be disqualified automatically should they fail to produce necessary identity documents or are late in collecting the Prizes.
  19. Prize Winners must make reservations with the relevant third party service provider in accordance with their respective terms and conditions within the validity period of each Prize in order to redeem the services in relation thereto and Prize Winners are recommended to do so at least 2 weeks before checking-in to ensure availability of rooms under each Prize. Tumi is not liable in case of any delay in making reservations or redemption of any of the services under the Prizes. Prize Winners must present the original voucher and valid identification documents to the relevant third party service providers upon redemption for the services.   20. Tumi accepts no responsibility for any tax implications and the Prize Winners must seek their own independent financial advice in regards to the tax implications relating to the Prizes or acceptance of the Prizes.
  21. Tumi may suspend or cancel the Event at any time at its sole discretion without giving any reasons. In no event shall Tumi be liable for any loss or damages suffered by any Eligible Customers, Prize Winners or third parties for such suspension or cancellation.
  22. These Terms and Conditions are construed by the laws of Hong Kong Special Administrative Region (“Hong Kong”) and the Eligible Customers/ Prize Winners agree to submit themselves to the jurisdiction of the Courts of Hong Kong in case of disputes.
  23. These Terms and Conditions are written in English and Chinese. In case of discrepancies, the English language version shall prevail.
